Student beaten on San Jose State University campus in Hate Crime Attack

"Prosecutors have charged two men with hate crimes, for attacking a San Jose State University student on campus while the two men yelled anti- gay slurs", said Santa Clara County District Attorney's office in a statement.

The two men, Josue Medina Flores, 19, of Sunnyvale, and Christian Gabriel Nunez Petty, 20, of Fremont will be arraigned Wednesday, at the Hall of Justice in San Jose to face the felony charges of hate crime and assault.

The District Attorney's office has stated that the attack was unprovoked, Flores and Petty have been accused of brutally kicking and punching the student, and his female friend who was present trying to help and protect him.

The incident occurred at the early morning hours of Saturday, September 19, when the victim and two of his friends walked past Flores and Petty in the University's downtown part of campus. The two men asked the student if he was gay, when the victim ignored their questions that is when their attack began.

"The two men then ran up to the victim and attacked him, punching and kicking him over a dozen times, all while yelling homophobic slurs."

Investigators say that the attack was caught on a security camera. If convicted the two men could face prison time.
